On March 12, 2025, Nichia Corporation (“Nichia”) filed a lawsuit in the Düsseldorf District Court against Taiwanese LED manufacturer Everlight Electronics Co., Ltd. and its German subsidiary Everlight Electronics Europe GmbH (“Everlight”). Based on two previous final judgments made by the Düsseldorf District Court, Nichia is seeking damages of 2.5 million euros for patent infringement in this lawsuit.
Both aforementioned Düsseldorf District Court decisions relate to Nichia's YAG patent EP 936 682 (DE 697 02 929). In the first decision (Case No. 4b O 56/12), the court acknowledged that Everlight infringed Nichia's YAG patent. In the second decision (Case No. 4b O 161/17), Everlight admitted to all of Nichia's claims, and therefore the court ruled in favor of Nichia regarding these claims.
Because Everlight initially argued that its liability for damages was limited to the products specifically listed in the infringement judgment and refused to submit accounting records for other products, Nichia initiated enforcement proceedings, and the court ultimately affirmed Nichia's legal claims. Based on this, Everlight has accepted its legal obligations and has submitted complete accounting records.
Nichia believes the reasonable amount of damages should be €2.5 million. This amount was calculated based on accounting records submitted by Everlight. Therefore, Nichia has initiated court proceedings and is claiming this amount of damages.
Nichia is committed to protecting its patents and other intellectual property rights and will take action against infringers in any country, where appropriate and necessary.
